TERMS OF PRODUCT PURCHASE AND USE

This Agreement is between You ("Purchaser," "You," "Your") and Grow As You Are, LLC ("Company," "We," "Us," "Our"), created and led by Dr. Siena Whitham, PhD, for the purpose of outlining the terms ("Terms") governing the purchase and use of any digital products, programs, or services ("Product(s)") purchased through this website, Kajabi, Zoom, or any related domains or platforms (the "Sites").

By purchasing any Product(s), You agree to be bound by these Terms without modification. If You do not agree to these Terms, please discontinue use of the Product(s) immediately.

Scope of Product Purchase and Use
The Company's Product(s) include, but are not limited to:
* Online courses and programs, including SPACE to Grow
* Live and recorded group educational sessions
* Digital downloads, PDFs, guides, worksheets, and templates
* Supplemental educational materials

All Product(s) are delivered digitally and/or through an online learning platform.

Educational Purpose Only / No Therapy or Clinical Services
All Product(s) offered by Grow As You Are, LLC are educational and coaching-based in nature. They are not psychotherapy, not psychological treatment, and do not establish a therapist-client relationship between You and the Company or Dr. Siena Whitham.

You understand and agree that:
* Participation does not constitute mental health treatment
* The Product(s) are not a substitute for individualized psychological care
* You are responsible for seeking appropriate professional support when needed
* Dr. Siena Whitham is acting in an educational capacity only, not as Your treating psychologist

Intellectual Property
All Product(s), including but not limited to course materials, videos, recordings, worksheets, written content, and frameworks, are the exclusive intellectual property of Grow As You Are, LLC, and are protected under United States copyright law (17 U.S.C. §101 et seq.).

You may not:
* Share, distribute, reproduce, resell, sublicense, or publicly display any Product(s)
* Provide access to Product(s) to any third party
* Upload Product(s) into other programs, platforms, communities, or AI tools
* Copy or adapt content for professional, clinical, or commercial use

Unauthorized use may result in:
* Immediate termination of access without refund
* Invoicing for unauthorized licenses
* Legal action to the fullest extent permitted by law

Age of Majority
By purchasing any Product(s), You affirm that You are at least 18 years of age and legally capable of entering into a binding contract.

Purchase Policies & Refund Policy
Because access to the Product(s) is granted immediately upon purchase — including access to proprietary materials, recordings, and educational content — refunds are limited as follows:

Refund Window Rules (based on time since purchase)
* Risk-Free (0–48 hours after purchase): 100% refund of the amount paid to date is available upon request.
* Partial (48–168 hours after purchase): 50% refund of the amount paid to date is available upon request.
* No Refunds (168 hours / 7 days and later): no refunds, chargebacks, or cancellations will be issued.

This policy applies to:
* One-time payments and installment plans
* Live and/or recorded sessions
* Partial participation or non-attendance

Installment plan clarification:
* Refunds (if available under the timing rules above) are always calculated as a percentage of the amount actually paid to date, not the full program price.
* If a refund is granted, future scheduled payments will be canceled.
* If no refund is available (168 hours / 7 days and later), remaining installments (if any) remain due.

Access Upon Refund:
If a refund is granted (full or partial), Your access to the Product(s) will be revoked. You will no longer be able to log into, view, stream, or download any course materials, recordings, or community content within the Sites. You acknowledge that the Company cannot control or retrieve any materials You may have already downloaded prior to the refund, but Your license to use the Product(s) is terminated upon refund.

License to Use Product(s)
Upon purchase, the Company grants You one (1) non-transferable, revocable, non-exclusive license to access and use the Product(s) for personal, non-commercial use only.

You may:
* Download and print materials for personal reference
* Participate in live and recorded sessions as intended

You may not:
* Share login credentials
* Record, redistribute, or repurpose any portion of the Product(s)
* Use materials for client-facing, professional training, or commercial purposes

Violation of this license may result in immediate revocation of access without refund.

Community Participation & Confidentiality
If the Product(s) include group sessions or community spaces, You agree to:
* Maintain the confidentiality of other participants
* Refrain from recording, screenshotting, or sharing group discussions
* Engage respectfully and without harassment or disruption

The Company reserves the right to remove any participant who violates community guidelines, without refund.

No Warranties
ALL PRODUCT(S) ARE PROVIDED "AS IS."
THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
* FITNESS FOR A PARTICULAR PURPOSE
* ACCURACY OR COMPLETENESS OF INFORMATION
* GUARANTEED RESULTS OR OUTCOMES

Use of the Product(s) is at Your own discretion and risk.

Limitation of Liability
To the maximum extent permitted by law, Grow As You Are, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to Your participation in or use of the Product(s).

Maximum Damages
In no event shall the Company's total liability exceed the total amount paid by You for the Product(s).

No Guarantees
The Company does not guarantee any specific outcomes, including but not limited to behavioral, emotional, relational, educational, or functional changes. Results vary based on individual circumstances beyond the Company's control.

Sales Tax
Applicable sales tax will be calculated and collected at checkout in accordance with state and local laws.

Entire Agreement
This Agreement constitutes the entire agreement between You and the Company and supersedes all prior communications or agreements. Any modifications must be made in writing by the Company.

Governing Law & Venue
This Agreement shall be governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any disputes arising under this Agreement shall be resolved exclusively in state or federal courts located in Michigan.

Mediation Requirement
Before initiating legal action, the Parties agree to attempt good-faith mediation. Each Party shall bear its own costs unless otherwise agreed in writing.

Severability & No Waiver
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any provision does not constitute a waiver.

Assignment
This Agreement may not be assigned or transferred by Purchaser without prior written consent from the Company.
